PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE USING OUR SERVICE. THIS AGREEMENT SETS OUT THE LEGALLY BINDING TERMS FOR YOUR USE OF OUR SITE. BY OPTING IN (AS DEFINED BELOW), YOU AGREE TO THESE TERMS AND TO RESOLVE DISPUTES WITH PRIME HOME REMOD THROUGH BINDING ARBITRATION, AND YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION, AS DESCRIBED IN THE “DISPUTES” SECTION BELOW.

Definitions

For purposes of these Terms of Use:

  • “Affiliate” means any entity that controls, is controlled by, or is under common control with a party.
  • “Country” refers to the United States.

  • “Device” means any device used to access the Service, such as a computer, phone, or tablet.
  • “Emails” means one or more emails sent to your email address for informational, transactional, marketing, promotional, or sales purposes.

  • “Text Message Service” means any arrangement under which Prime Home Remod sends, or may send, one or more text messages, including recurring messages, to your phone number.
  • “Feedback” means feedback, ideas, or suggestions you send us about the Service.
  • “Promotions” means contests, sweepstakes, or other promotions offered through the Service.
  • “Service” refers to the Website.
  • “Terms” means these Terms of Use, forming the entire agreement between you and the Company regarding use of the Service.
  • “Website” refers to the Prime Home Remod website.
  • “You” means the individual, company, or other legal entity accessing or using the Service.

  • By opting in, you confirm you are the subscriber or authorized user of the phone number provided.
  • We are not responsible for delayed or undelivered messages; supporting carriers may change without notice.

Opting In to Outbound Telephone Calls

  • You authorize Prime Home Remod to call, including using automated dialing technology or prerecorded messages, to verify your contact information, share account or project updates, or market our services, even if your number is on a Do Not Call list.   • By opting in, you confirm you are the subscriber or authorized user of the phone number provided.

  • You authorize Prime Home Remod to send you emails — individually or as part of a broader campaign — to verify your contact information, share account or project updates, or market our services.   • By opting in, you confirm you are the owner or authorized user of the email address provided.

Opting into any Service is never a condition of purchase. By opting in, you consent to our use of an electronic record of your authorization. You may withdraw consent at any time by contacting us at +1-734-530-0344; these Terms will continue to apply even if you withdraw consent or opt out.

About the Services and Opting Out

  • Emails – We may stop sending emails at any time, with or without notice. To unsubscribe, use the link at the bottom of any email; in some cases we may ask you to clarify which type of emails you wish to stop receiving. We may still send certain transactional emails.
  • Outbound Telephone Calls – We may stop making calls at any time, with or without notice. You may revoke consent by contacting us at +1-734-530-0344, or by telling a Prime Home Remod representative during a call.

Promotions

Any Promotions offered through the Service may be governed by separate rules. If those rules conflict with these Terms, the Promotion-specific rules will control. Please review the applicable rules and our Privacy Policy before participating.

Free Consultation Incentive

From time to time, homeowners who complete an in-home consultation and receive an estimate for roofing, window, siding, gutter, or gutter protection services may be eligible for a promotional gift, as described in the applicable offer. Offers are limited to one per household, valid for homeowners 18 or older, and require that all cohabitating decision-makers attend the consultation together. Participants must present valid photo ID and be legally able to enter into a contract. Prior consultation participants and current or former customers may not be eligible. Gifts cannot be transferred or exchanged for cash, except that we may substitute an item of equal or greater value. Offers may not be combined with other promotions or discounts and are subject to change without notice.

Intellectual Property

The Service and its content, features, and functionality (excluding content you or other users submit) are and will remain the exclusive property of the Company and its licensors, and are protected by copyright, trademark, and other applicable laws. Our trademarks and trade dress may not be used without our prior written consent.

Your Feedback to Us

You assign to us all rights, title, and interest in any Feedback you provide. If that assignment is ineffective for any reason, you grant us a non-exclusive, perpetual, irrevocable, royalty-free, worldwide license to use, reproduce, modify, and exploit that Feedback without restriction.

Our Service may link to third-party websites we do not own or control. We are not responsible for the content, privacy policies, or practices of those sites, and we encourage you to review their terms and privacy policies before engaging with them.

Termination

We may suspend or terminate your access to the Service at any time, without notice or liability, including if you breach these Terms. Upon termination, your right to use the Service ends immediately.

Limitation of Liability

To the maximum extent permitted by law, our total liability, and your exclusive remedy, for any claim relating to the Service is limited to the amount you paid us through the Service, or $100 if you have not made a purchase through the Service.

In no event will the Company or its suppliers be liable for special, incidental, indirect, or consequential damages — including lost profits, lost data, or business interruption — arising from your use of, or inability to use, the Service, even if advised of the possibility of such damages. Some states do not allow these limitations, so they may not apply to you; where that is the case, liability will be limited to the greatest extent the law allows.

“As Is” and “As Available” Disclaimer

The Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, accurate, or free of harmful components. Some jurisdictions do not allow these exclusions, so some may not apply to you; in that case, these exclusions will apply to the greatest extent the law allows.

Governing Law and Disputes

These Terms are governed by the laws of the Country, without regard to conflict-of-law principles. Your use of the Service may also be subject to other applicable local, state, or national laws.

Disputes

Any dispute or claim relating to the Services will be resolved exclusively through binding arbitration rather than in court, except that you may bring a qualifying claim in small claims court. The Federal Arbitration Act governs these Terms.

BY AGREEING TO ARBITRATION, YOU UNDERSTAND YOU ARE WAIVING YOUR RIGHT TO PURSUE OTHER DISPUTE RESOLUTION PROCESSES, SUCH AS A COURT ACTION. ARBITRATION RULES DIFFER FROM COURT RULES — THERE IS NO JUDGE OR JURY — BUT AN ARBITRATOR CAN AWARD THE SAME INDIVIDUAL DAMAGES AND RELIEF A COURT COULD, SUBJECT TO THE SAME LIMITATIONS IN THESE TERMS.

To start an arbitration, send a demand describing your claim to the American Arbitration Association (AAA) and serve a copy on us at Prime Home Remod, Attn: Legal Department. Arbitration will follow AAA rules, including its Supplementary Procedures for Consumer-Related Disputes, available at www.adr.org or by calling 1-800-778-7879. We will reimburse AAA filing and administration fees (not attorney’s fees) for claims under $10,000, unless the arbitrator finds the claim frivolous. Arbitration may be conducted by phone, on written submissions, or in person in the county where you live or another mutually agreed location.

Disputes will be handled individually, not as part of a class, consolidated, or representative action, and an arbitrator may not combine more than one person’s claims. If a claim proceeds in court instead of arbitration for any reason, both parties waive the right to a jury trial to the extent permitted by law.

Applicable Law

THE LAWS OF THE STATE, WITHOUT REGARD TO CONFLICT-OF-LAW PRINCIPLES, WILL GOVERN THESE TERMS AND ANY DISPUTES OR CLAIMS AGAINST PRIME HOME REMOD ARISING FROM THE SERVICES.

United States Legal Compliance

You represent that you are not located in a country subject to a U.S. government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. government list of prohibited or restricted parties.

Severability and Waiver

Severability

If any provision of these Terms is found unenforceable or invalid, that provision will be interpreted to accomplish its objectives to the extent possible, and the remaining provisions will remain in full force.

Waiver

Our failure to enforce a right or provision under these Terms will not be treated as a waiver of that right, nor will waiving one breach waive any later breach.

Translation Interpretation

If we provide a translated version of these Terms, the original English version will control in the event of any conflict.

Changes to These Terms

We may modify these Terms at any time at our discretion. For material changes, we will make reasonable efforts to give at least 30 days’ notice before the new terms take effect. Continuing to use the Service after changes take effect means you accept the revised Terms; if you disagree with the changes, please stop using the Service.
